Irwin Untermyer, son of Samuel Untermyer, may be appointed Supreme Court Justice by Governor Franklin D. Roosevelt of New York State, upon the creation of a vacancy by the resignation of Judge Thomas C. T. Crain, who was nominated on the Democratic ticket for District Attorney.
Mr. Untermyer’s appointment is favored by former Governor Smith and Mayor Walker, it is understood. It was said that endorsement of Mr. Untermyer’s appointment is under consideration by John F. Curry.
Mr. Untermyer was associated with his father in the Transit Commission’s negotiations for the five-cent fare in the New York City Subways.
