An important victory for German Jews was achieved here today when the Nazi regime of Germany admitted to the Upper Silesian Mixed Commission of the League of Nations that it was guilty of having ousted Jewish doctors from the sick fund panels of Upper Silesia for no other reason save that they were Jews. Upper Silesia is a plebiscite area under the jurisdiction of the League of Nations.

The German government officially recognized the justification of the claims advanced by the Jewish doctors Fuereisen and Frenkel of Beuthen, Upper Silesia, and agreed to reinstate them in the panel system and to pay them damages for the time during which they were ousted. The German government, however, refused to acknowledge its guilt in the case of Dr. Sweinbel also of Beuthen.

SIMILAR CASES PENDING

The Mixed Commission, which is under the chairmanship of Dr. Felix Calonder of Switzerland, announced sometime ago that it would consider the case submitted by Dr. Sweinbel, who declared {SPAN}##{/SPAN} he had been dismissed merely because he was a Jew.

Similar cases submitted by a number of other Jewish doctors are also pending before the Mixed Commission and the decision is considered highly important.

Despite the fact that the League of Nations upheld the petition submitted by Franz Bernheim, Upper Silesia Jewish resident, that the German government had no right to dismiss Jews from the government and to oust Jewish professionals, numerous complaints have been made to the League that Germany consistently was violating the pledges she had given.
