Federal authorities said today that William Dudley Pelley, anti-Semitic leader of the Silver Shirts who faces a 15-year prison term for sedition, “might” be required first to serve a term in North Carolina for violation of a state law.
Pelley, whose motion for a new trial on the sedition charge was denied, has filed notice that he would appeal to the Circuit Court at Chicago. The anti-Semitic leader also is wanted by North Carolina on a conviction under the state’s blue sky laws.
Oscar R. Ewing, New York attorney who prosecuted Pelley, said there was “every possibility” that Pelley would be turned over to North Carolina before beginning his 15-year federal term. Pelley also faces trial on another federal indictment charging him and 26 others with subversive activities.
