Dr. Philip Auerbach, former head of the Bavarian State Restitution Office who has been arrested on charges of fraud and falsification of documents was reported today to he seriously ill. He was transferred to the Stadelheim prison hospital.

Dr. Joseph Miller, Bavarian Minister of Justice, who last week said that an investigation by the office of the public prosecutor failed to produce evidence of criminal acts by Dr. Auerbach and that his removal from office was due to his lack of technical qualifications for the job, today stated that Dr. Auerbach twice failed to hand over his passport when requested to do so by the public prosecutor. A plane ticket for the United States was found in his desk, giving reason to suspect that he planned to leave the country, the Minister said.
