An Ontario Supreme Court judge has upheld a clause in the will of a Jew which bequeathed $10, 800 to his three granddaughters if they agreed to marry Jews and to observe the Jewish dietary laws in their homes after marriage.
Justice Leo Landreville held that the condition was a valid one, and was not a restraint of the marriage rights of the granddaughters. He ordered the money held in trust until each of the granddaughters “has the capacity to agree to the clause. ” Under the will, the money will go to charity if the conditions are not fulfilled by the granddaughters.
