The court here rejected today a demand by the defense attorney in the Grodno war crimes trial that the presiding judge be removed for alleged prejudice, The demand arose from the dismissal by Judge Von Mallinckrodt of a prosecution witness who collapsed from exhaustion while undergoing cross examination on April 4. The witness, Max Dolub. of New York, made serious charges against one of the defendants in connection with the massacre of Jews in Grodno, Poland. during the Nazi occupation in World War II. The defense objected at the time because Dolub had announced prior to the trial that April 4 was the only day he would be available to give testimony. The judge released him from further appearance in court.
