55 Arraigned on Kosher Poultry Trust Charges Before Judge Mack

Fifty-five of the seventy-one defendants named in the live poultry case which is being prosecuted by Israel B. Oseas, John Harlan Amen and Walter. L. Rice, Special Assistants to the Attorney General, were arraigned Friday afternoon before Judge Julian W. Mack in the District Court. Eight bench warrants were issued for defendants who failed to appear and immediate appearance for five of the defendants was promised by attorneys representing them. Five of the defendants being either incorporated or unincorporated associations in New York and New Jersey were not required to give bond under the Sherman Anti-Trust Act.

The bail for the fifty-five defendants aggregated $154,000. and it is expected that this total will mount to approximately $200,000. when all of the defendants have been arraigned. All defendants pleaded not guilty to the charge of violation of the Sherman Anti-Trust Act. The date of the trial has not been fixed.

Five of the alleged gangsters including Arthur alias “Tootsie” Herbert, Charlie Herbert, Abie Newman, Joe Weiner and David Hershon were held on $5,000. bail upon the assertion of Mr. Oseas that they had been engaged in the recent acts of violence. Judge Mack fixed $4,000 bail for Charles Scharer, one of the alleged leaders of the conspiracy in New Jersey. John J. Con-lin, delegate for the New Jersey local of the International Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers of America, is still in Wales but his attorney announced that he would be presented immediately upon his return in September.

The associations arraigned include the Greater New York Live Poultry Chamber of Commerce, the Newark Live Poultry Association, the Official Orthodox Slaughterers of America and the International Brotherhood of Teamsters. Chauffeurs, Stablemen and Helpers of America, Local 167 New York, and Local 560, New Jersey.

Bail of $2500. was fixed for the following who include members of the Chamber of Commerce, alleged gangsters and delegates. Ben Franzel, Barney Azwolinsky, Hyman Nierenberg, Max Katz David Manne, Sam Manne, Isidor Rosenberg, Abie Wolfe, Morris Gerber, Ruby Goldberg, Sam Isaacson, I. Lipschitz, J. Damsky, M. Damsky, Max Gold, Jake Koslov, Morris Pepper, Joseph Scull, Jake Frankfater,. Hyman.. Frankfater, Benjamin Simon, Louis Spatz, Jacob Reisner, Max Wolas, Louis Cohen, Abe Franzel, Louis Gerber, Samuel Gold, Morris Gordon, Leo Kassoff, Samuel Mamber, Charles Mirotznik, Samuel Sahn, Louis Schenckman, William Simon, Louis Weidberg, Samuel Libkin, Hyman Haber, Jake Haber, Samuel Sil-verman, Harry Shomer, Kolman Shapiro Hyman Fishman, Sam Eichner, David Berl. Bench warrants were issued for the following who failed to appear, Benjamin Rothschild, Richard Ditchik, Sidney Rosenstein, Harold Firestone, Aaron Wissler, Julius Rosenstein, David Kauf-man and Moe Rosenstein. Several of them are reported to be in Canada and several on vacations.

Charles Scharer, inspector of the Newark Live Poultry Associaton, protested after the arraignment that he should be selected for prosecution from the Newark poultrymen when he was no more implicated in the conspiracy than they. He was assured by Mr. Oseas and Mr. Rice that the list of defendants was elastic and could be readily expanded before the trial to as many as two hundred and fifty.

Funeral services for Mrs. Fannfe Scherer, widow of Moses Scherer of New York City who for years was active in aiding immigrants and other charities, were held Friday. Burial was in Mount Zion Cemetery. Rabbi Leo Goldberger of the Hungarian Synagogue conducted the service. Mrs. Scherer was born in Austria fifty-eight years ago and for the last forty years was active in philanthropic work in the Rivington-Columbia Street district.

The funeral cortege passed the Yeshiva on Houston Street, the Israel Orphan Asylum on Second Street and the Hungarian Synagogue on Third Street, in all of which Mrs. Scherer had been an active worker and to which she had given financial aid.
