The American Jewish Congress today filed a brief with the Federal Communications Commission summarizing the evidence it presented in six days of hearings in opposition to the application of the New York Daily News for a FM radio broadcast license. The brief urged FCC to deny the license to the Daily News.
The brief denies the contention of the Daily News that freedom of the press is an issue in the case, and that an examination by the FCC of the news columns and editorials of the Daily News to prove or disprove its bias against Jews and Negroes is an abridgment of the paper’s constitutional rights by a government agency.
The American Jewish Congress brief points out that there are seventeen applications for the five available FM channels in the New York City area and that the FCC is required, in making a choice among the applicants, to consider the “character” and past conduct of the applicants. It cites decisions on the United States Supreme Court that the FCC is not limited to a consideration of the engineering and financial qualifications of the applicants.
