A $50,000 counter-suit brought by Conde McGinley, publisher of the anti-Semitic sheet “Common Sense,” against Rabbi Joachim Prinz of this city has been dismissed by the New Jersey State Superior Court, and March 14th has been set as the opening date of a libel suit brought by Rabbi Prinz against Mr. McGinley. “Common Sense” was recently listed among neo-Nazi groups and publications marked as anti-Semitic in a report of the House Committee on Un-American Activities.
Dr. Prinz has charged that he was libelled in 1952 when “Common Sense” described him as a “red rabbi who was put out of Germany because of his revolutionary and communistic activities.” Mr. McGinley brought suit because Dr. Prinz was reported to have stated that “it’s about time this scurrilous sheet was put out of business.” The judge ruled that Dr. Prinz’ statement was not slanderous nor libellous.
