The Kammergericht, court of appeals, today annulled the ruling of the Berlin district court, cancelling the right of Jews to act as executors, in wills filed in German courts.
The court of appeals not only upheld the right of Jews to act as executors in wills filed by Jews, but also upheld the right of Jews to be executors for Aryans, if such a desire is expressed in the will of the deceased.
An executor does not necessarily act as lawyer, the appeals court explained, and therefore the Aryan clause cannot affect executors.
