The “Aryan” clause is valid despite the guarantees of the Weimar Constitution, the supreme administrative court of Hamburg ruled in disposing of a charge brought against the clause by a disqualified Jewish barrister.
In upholding the validity of the clause the court stated that the state may, for urgent reasons and in the interests of the community, remove functionaries.
