The Bavarian higher court has rejected applications for the release from custody of Dr. Philip Auerbach, former head of the Bavarian State Restitution Office, pending his trial on fraud charges, and for his transfer from a municipal to a private hospital.
Auerbach’s trial, after delays of more than a year, is now set for Wednesday though there are reports that it may again be postponed. The court, in denying application for his release, said that a medical report had shown him to be in improved health. The request for his transfer to a private hospital was denied on the grounds of the costs involved.
