The case involved an appeal by a member of the sect of Jehovah’s Witnesses who was arrested in Quebec for distributing religious tracts published by the sect, without having first obtained a permit. The court, in a five to four decision, upheld the appeal, although it did not abrogate the 20-year-old Quebec statute.
