Sigma Tau Gamma, a national fraternity, filed suit in a United States District Court here yesterday to restrain the State University of New York from banning national fraternities and sororities from colleges and universities under its administration.
The fraternity’s petition claimed that the group had no religious test for membership and did not discriminate against applicants for membership on religious, racial or color grounds. It called the action of the president and trustees of the State University “discriminatory and capricious.”The action of the State University was announced October 8 and will not be effective for a number of years.
