French Court Voids Will Which Barred Bequest if Beneficiary Married a Jew

A will barring a legates from a bequest in the event that she married a Jew has been voided by the Tribunal of the Seine, as running counter to the spirit and principles of the new French Constitution, which guarantees the equality of all citizens under the law.

The will of a certain Madams B left all her property to her grand-daughter, with the proviso that if the grand-daughter married a Jew, the bequest was to go to an orphan asylum fund. The young woman, who is unmarried, challenged the terms of the bequest and was upheld by the court. Her attorney was Andre Blumel, president of the Jewish National Fund of France.
