German embassy officials yesterday arranged to submit an official protest to the State Department over the opinion of Magistrate Louis B. Brodsky of New York handed down when he freed five anti-Nazis charged with unlawful assembly in connection with the tearing down of the swastika flag on the Nazi liner Bremen July 26.
The embassy officials said they had received instructions from their government in Berlin to forward to the State Department a vigorous protest against Judge Brodsky’s likening the Nazi flag to a “black flag of piracy” and declaring the riot was provoked by “the flaunting of an emblem to those who regarded it as a definite challenge to society.”
