The American Jewish Congress has intervened as “a friend of the court” in the action pending in the Massachusetts Supreme Judicial Court to invalidate an ordinance of the town of Dover prohibiting the erection or operation of religious schools in the town.
The action was brought by the Catholic order, the Dominican Fathers, who had sought to establish a seminary in Dover but were denied permission under a 1946 ordinance adopted by the town. A brief submitted for the Commission on Law and Social Action of the New England Division of the A.J.C. declared that the issue was “purely one of religious liberty.” Counsel for the Commission argued that “while the town of Dover may not subsidize the Dominican Fathers, it may not forbid them to erect and operate the school out of private funds.”
