The attempt of University Heights, a suburb of Cleveland, O., to bar the Cleveland Jewish Orphan Home from the village was again unsuccessful.
The village was refused a review of its zoning ordinance, involved in the case won in the Lower Courts by the Cleveland Jewish Orphan Home.
The home purchased a site in the village and applied for a permit to erect a central administration building, a central heaving and power plant, with a cluster of cottages. A permit was refused because the site was in a restricted zone.
Contending the refusal was based on the commission’s unwillingness to have ## part of the village used for charitable purposes the orphan home appended to the Federal Court, which held the village did not have the power to prohibit the construction.
