As soon as the State completed presentation of its case against William Dudley Pelley, anti-Semitic leader, and his associates, accused of violating the “blue sky law” of North Carolina through the sale of stock in corporations formed by Pelley and his colleagues, Robert H. McNeill of defense counsel made a motion for non-suit late today.
In making the motion the defense said that unfortunately the Supreme Court of North Carolina had never had a case parallel to this one and consequently could not base the argument on precedent.
McNeill said he had noticed the entire failure of the State to prove a single allegation of the indictment. In the conspiracy charge, he continued, the State failed to prove anything except to indicate that all four defendants had worked for the same corporation.
