San Francisco to Act on Racial and Religious Bias in Employment

Final action on FEPC legislation to bar racial and religious discrimination in employment in the city of San Francisco is expected before this week closes. After a final vote by the board of supervisors and signature by Mayor George Christopher, both already pledged, the Mayor will appoint a seven-member commission to begin functioning within 30 days.

The ordinance makes illegal employer refusal to hire or promote “because of race, color, religion, ancestry, national origin or place of birth.” However, the ordinance throws responsibility for proof of discrimination on the complainant, who must convince the seven-member commission that he was better qualified for the job than the person hired. It also lacks a penalty for discrimination, but provides for injunctive relief and up to 90 days back pay.
