The Supreme Court’s decision barring court enforcement of restrictive covenants was invoked here for the first time today when Superior Judge Padden dismissed an injunction which would have prevented a Negro family from taking possession of a house they purchased on Chicago’s South Side.
In upholding the family’s right to move into the house, Padden declared: "The supreme Court’s decision that restrictive covenants are not enforceable in the courts is very definite and left no room for argument. Restrictive covenants are at an end"
