The Appelete Division of the Supreme Court in Brooklyn upheld the conviction of Dr. David H. Shelling, attached to the Research Department of the Jewish Hospital, Brooklyn, before Magistrate Haubert in Flatbush Court, on the charge of cruelty to animals. One Justice dissented.
An agent of the Humane Society complained last June that on order of Dr. Shelling, tape had been bound around the muzzle of a dog at the hospital, making breathing difficult and torturing the animal. Dr. Shelling stated that the taping had been part of an experiment in connection with research work at the hospital and caused little discomfort. Magistrate Haubert suspended sentence.
