The United States District Court yesterday refused to issue an injunction barring enforcement by New Jersey authorities of the state’s Sunday closing law. The injunction had been sought by two retail discount chains–Two Guys from Harrison and Bargain City, U.S.A. –while the constitutionality of the law was being tested in Federal and State courts.
The firms had argued that they were being harassed by law enforcement officials and that the law should not be enforced because it was arbitrary and discriminated against them. The law, which was approved in 1959 in 12 of the state’s 21 counties, bans the sale on Sunday of clothing, furniture, household and office appliances and building supplies. Eight separate suits are now pending in five states and in Federal courts to test its constitutionality.
