Horace Samuel, attorney for Abraham Stavsky, whose appeal from conviction of the murder of Dr. Chaim Arlosoroff is now before the Palestine Appeals Court, today resumed his argument before the court, concentrating his fire on the irregularity in the procedure during which suspects were identified.
The probability that the second confession made by Abdul Mejid may not be admitted by the court was held when a high-ranking official of the Palestine police intimated to the Jewish Telegraphic Agency that Abdul denied he had made any statement to his attorney, Dr. Eliash, concerning his complicity in the murder of Dr. Arlosoroff.
Attorney Samuel not only attacked the method in which suspects were identified by prospective witnesses, but also pointed out that there had been irregularities in the manner in which the footprints of the suspects were identified by official police trackers.
The defense attorney also attacked the testimony of Moshe Weiser, who testified that he had been walking along the seashore on the night of the killing and had been accosted by a man who then walked on and that five minutes later he heard a shot and ran toward the scene of the crime. Samuel called the attention of the court to the fact that Mrs. Sima Arlosoroff, widow of the murdered man, has sworn that she had seen the two murderers long before they approached her husband and that therefore the man Weiser saw and whom he identified as Stavsky could not have been the murderer.
The hearing is expected to continue until tomorrow afternoon.
