Washington was wiring the Federation of the granting of its code, its president, Charles Cohen, and four members of the Rockaway local of the Federation were acquitted in Queens Special Sessions Court of charges of monopoly, conspiracy and coercion brought by Bernard L. Bienstock, Assistant Attorney General attached to the anti-Racket Bureau.

Justices Salomon, Dale and Hackenberg granted a motion by defense counsel John J. Donovan to dismiss after the prosecution had presented its case.

Sam Grabel, owner of a butcher shop in Rockaway, appeared as complaining witness and charged the Federation with attempting to force him to fix prices and threatening violence when he refused.
