The Spalato district court has ruled that Yugoslav debtors of confiscated Jewish firms in the Reich should pay their debts to the Jewish owners abroad.
The verdict was issued in an action brought by a Nazi commissar in the Vienna Jewish firm of Hirschl and Company against the Yugoslav firm La Dalmatienne, which hap paid its debt to the owner, who is now a refugee, rather than to the Commissar.
In rejecting the commissar’s claim, the court ruled that it could not recognize the institution of a commissar appointed on racial grounds, since that was in contradiction to the Yugoslav Constitution which guarantees equal rights for Jews and because it would serve to support principles alien to the Yugoslav State.
