The Appelate Division today announced that the use of discriminatory pre-employment inquiries by employment agencies is prohibited. The court upheld the powers of the New York State Commission Against Discrimination, which had ordered the Holland Vocational Service in New York to stop using a questionnaire containing inquiries about a person’s creed and national origin. The case was the first test in an appellate court of the commission’s power to issue such an order.
