No action has been taken by the Justice Department to list Lincoln Rockwell’s neo-Nazi group as subversive because of “free speech” considerations, the Department of Justice made known today.
Assistant Attorney General J. Walter Yeagley said today that “notwithstanding the highly offensive nature of these activities, they usually involve the interpretation and application of the free speech and assembly guarantees of the First Amendment to the Constitution and, generally speaking, fall within the protection of these Constitutional safeguards.”
Mr. Yeagley revealed the Department’s decision in a letter to Rep. Seymour Halpern, New York Republican. Assurance was given that the Department would continue looking into the neo-Nazi situation. If inquiries should develop sufficient evidence, said Mr. Yeagley, appropriate Justice Department proceedings will be instituted.
