The Kansas Supreme Court ruled the state’s Sunday closing law unconstitutional on the grounds it was vague and discriminatory.
The court unanimously ruled that the law passed by the 1963 legislature, was “repugnant to the Kansas constitution, which guarantees equal rights to all persons.” The law was the second attempt by the Kansas legislature to pass a valid Sunday-closing act. The first act, passed by the 1961 legislature, also was held unconstitutional.
