The Court of Appeals has dismissed claim by Commander Godman of the British Navy against Robert Pell, United States State Department official assigned to the Intergovernmental Refugee Committee, for services rendered on behalf of the committee in establishing contact with the heads of the German Government in September, 1938. Mr. Pell at that time was assistant to George Rubles, Washington attorney who was the committee’s first director.
The appeal was dismissed on the ground that the action was brought against sovereign states through their agents. While the appeal concerned only Pell, the action was brought against Lord Winterton, chairman of the committee, Rublee and another assistant, Joseph Cotton.
