The State’s Attorney of Hesse, who was suspended last December following disclosures that he had prevented the trial of an official accused of having ordered the execution of 75 Jews, has been placed temporarily on the pension list, the Hessian Ministry of Justice confirmed today.

The ministry asserted that Dr. Otto Schweinsberger, the suspended prosecutor, cannot be brought to trial or subjected to disciplinary action because of the statute of limitations. A spokesman said Wiesbaden officials had reviewed documentary evidence against Schweinsberger in East Berlin, which confirmed the charges against him.
