Complete acquittal for Abraham Stavsky as well as for Zvi Rosenblatt was demanded by Judge Moshe Valero, Jewish member of the Court of Assizes which found Stavsky guilty and Rosenblatt innocent of the murder of Dr. Chaim Arlosoroff, Haaretz, Hebrew daily, reported today.
Judge Valero filed a decision differing from that of the two British and one Arab judges who, with him, constituted the court. His minority decision went to the Court of Appeals with the verdict of the majority.
Among the points on which Judge Valero based his decision were the following:
First, that no motive for the murder was established.
Second, that the murder seemed to be a sexual crime rather than a political murder because the Tel Aviv seashore, where the crime took place,, lends itself “to immoral intentions.”
Third, it was not established that any connection existed between Stavsky and Rosenblatt.
Fourth, without necessarily having had wrong intentions, Mrs. Sima Arlosoroff, widow of the victim and witness of the murder, may nevertheless have been mistaken in her identification of the accused men.
Fifth, the alibis put forward by both Stavsky and Rosenblatt were sufficiently convincing and thus both men should have been acquitted.
