Deploring that under the law it must continue opposition to the admission of the wife and child of Rabbi Solomon Gottlieb of New York, the Department of Justice in a brief filed with the Supreme Court declares that the principle vital to the maintenance of the restrictive immigration law was at stake.
“This appeal presents a case of hardship that naturally excites our sympathy”, said the brief. “While legislative policy is not for the executive department, we venture the opinion that there should be such elasticity in the law as would permit the Immigration
Commissioner to make an exception in isolated cases, where the enforcement of the law requires the separation of a family, a result which seems to us abhorrent”.
