The District Attorney here has refused to permit his assistant prosecutor Dr. H. Mueller to testify in the so-called “Jewish bank” case about a deposition given last year by Dr. Philip Auerbach, German Jewish head of the Bavarian Restitution Office who later committed suicide. The court had summoned Dr. Mueller, to give evidence after he had been named as an important witness by Joseph Klibansky, a defendant in the case and Germany’s best known Jewish attorney.
The trial, which has been in progress since last fall, and is expected to continue until next month, involves violations of foreign currency laws, and alleged fraudulent bankruptcy, by five persons connected with the former “Jewish Restitution Bank” here. From testimony offered to date it has become clear, however that the bank’s assets exceeded its liabilities when it was closed by the state of Hesse in 1950.
