Judge ## H. Breidenbach of the Circuit ## Wednesday overuled the demurtors in the suit of Max Polacheck ## the Michiwaukee Golf club, ## giving the plaintiff and several that members of the organization a ## to see directors for conspiring to ## them because they are of the Jewish faith.

The suit instituted in May was the result of eigh Jewish members of the club receiving notices from its officers requesting their resignations.

The other actions against the club and the Michiwaukee Golf Club Land company are brought by Joseph M. Dribben and Charles and Adolph Polacheck.

The court in deciding there was a cause of action, said. “The complaint in effect charges a conspiracy on the part of the defendants to harm and injure this group of members for whom they are trustees. In so acting, it is alleged that defendants abused their trust and are guilty of gross misconduct. It is conceded that the plaintifi having obtained membership could not be arbitrarity expelled. The statement therefore in the complaint charging a conspiracy to being about a result which could not be accomplished directly, coupled with the statement that such attempt was without just cause or provocation, sufficiently alleges bad faith on the part of the defendants.”

The defendants, in filing their demutter admitted ousting the plaintiff, but alleged such action on their part did not produce a cause of action against them.

The complaint field by Mr. Polacheck ## that the purpose of the defendant ## Club is to conduct the club for the thus interests of the members thereof.” that in the organization of the said corporation a Jarge number of men of Jewish faith were invited to and did become original members that without cause of provocation the directors…. dec##ed to request and did request by letter….the resignation of eight Jewish members of said corporation that the plaintiff is informed and believes that the action of directors and officers in requesting the resignation of said members was but one step in a plan and a ## to cause the withdrawal from membership of the corporation of all members who were of Jewish faith; that by said letter. the directors and officers “conspired together for the purpose of causing said eight members of Jewish faith including this plaintif. to whom was sent such a letter… to resign as members of said corporation and …. cause other members of said corporation of Jewish faith to resign on account of the fact that they would naturally feel that they were undesirable and not wanted as members of said corporation solely because of the fact of their Jewish faith:” “that in so conspiring and so acting the defendants individually named abused their trust and were guilty of gross misconduct.”

Mr. Polacheck is also a member of the Michiwaukee Golf Land company, which owns 120 acres of land in Fox Point now leased by the club. He refused to resign because the notice did not set forth the reason.

Judge Breidenbach signed an order for the examination of all the officers of the Michiwaukee Golf club under the suits brought by Max Polacheck and others. The hearings were adjourned for a later date.

Ground was broken last Friday for the new Brynwood Country club golf links, located about five miles north of the city on Good Hope road and about one-half mile west of the Tripoli Country club.

President Morris Stern turned up the first earth in the presence of a number of charter members of club.

Officers of the new club are Morris Stern. president; Dr. Louis Koppel vice-president: L. G. Strauss. secretary. and Edward D. Fryer. treasurer. Director are Ben Lewenauer. Nate Franklin. Michael Levin. Ferman R. Blink. A. J. Bitker. Louis Rosenberg. Wiliam Zitron Barney Rasansky, and E. P. Yolles.
