Court Dismisses Speculation Charge Against Jew Who Refused to Trade on Sabbath

The Court of Appeal today dismissed the charges against Lupu Fain, a Jewish merchant of Berescht, who was indicted ### charges of speculation because he refused to trade on the Sabbath or Jewish holidays.

The court annulled the charges against Fain and dismissed the action declaring the indictment constituted a misapplication of the law referring to speculation.

The case had aroused considerable public attention and had even come up before Parliament where questions were asked concerning it.

A representative of the Ministry of Commerce was invited to give evidence to the Court and a statement was submitted in Fain’s behalf by Dr. William Filderman, president of the Jewish Community of Bucharest.

Had Fain been found guilty, he would have faced a prison term of from three to nine months and the payment of a fine of 30,000 lei.
