Asserting that for 4,000 years it has been the Orthodox Jewish law that a “get” (divorce) must be the voluntary action of the husband in order to be valid, Judge Eugene O’Dunne dismissed a petition filed by Miss Rose Zerlin asking that her former husband be required to give her a “get.”
Isidor Levin, from whom she was civilly divorced, contracted with her to apply for a Jewish divorce, Miss Zerlin claimed. Judge O’Dunne said a “get” could not be contracted for and unless granted wholly voluntarily by the husband was not binding in the faith.
