Label Defacing Law to Be Tested Thursday

A hearing has been set for Thursday morning at the First District Magistrates Court in an action brought by the Non-Sectarian Anti-Nazi League to test the effectiveness of Section 435-C of the Penal Code which applies to mutilation or concealment of point-or-origin labels on imported merchandise. A summons issued by Magistrate Irwin last week against Leon Nelson of 95 Orchard St. forms the basis of this action.

Fannie Rosen of the legal division of the League presented evidence indicating that a label on a box of thumb tacks marked “Made in Holland” concealed a German marker underneath.
