Two Jewish employees of the Barasch department store in Magdeburg, sentenced to two years imprisonment for being on friendly terms with a number of German girl employees, have had their sentences quashed by the Federal Court of Appeal which has ordered a retrial.
The higher court found that the Magdeburg Criminal Court was justified in considering that the two accused had committed an offense, not against the honor of the girls themselves, who were of age and responsible for their actions, but against the honor of the girls’ parents. It has not been proven however, the court ruled, that the Jews were aware of such an offense.
