A West German Government spokesman told the Jewish Telegraphic Agency today that Chancellor Kurt George Kiesinger would not ask the Constitutional High Court at Karlsruhe to determine whether or not the neo-Nazi National Democratic Party operated within the national constitution.

The government has been concerned about measures to check the growth of the neo-Nazi organization which has won seats in six provincial legislatures. The coalition partners split on proposals to amend the election laws and it had been reported that the Chancellor would seek to have the Karlsruhe court declare the NPD unconstitutional. The Chancellor, however, is apparently unprepared to take that course of action.
