State Prosecutor Upholds Appeal for Former Auschwitz Guard

The State Prosecutor surprised a court here yesterday by recommending that it uphold an appeal by a former guard at the Auschwitz death camp who was sentenced to a three-and-a-half year prison term for complicity in the deaths of inmates. According to the Prosecutor, the defendant, Dr. Bernard Lucas, had only obeyed orders. The case is the first in which a prosecutor has supported an appeal by a war criminal he helped to convict.
