A “novel and surprising decision” was the comment made yesterday by the Jewish Sabbath Alliance in reference to the judgment passed Tuesday on Charles Horowitz, 3 Mott street, by Magistrate William A. Farrell in Tombs Court. Horowitz was found guilty of selling merchandise on Sunday, despite his plea that he remained closed Saturdays. He was fined $10.

This is the first time such a severe penalty has been imposed on a first offender, according to the Alliance whose counsel, Herman Koenigsberg, defended Horowitz in court.
