THE SUPREME COURT HAS RECOGNIZED THE RIGHT OF 23 JEWISH DOCTORS, WHO HAD WORKED FOR A LONG TIME IN VIENNA HOSPITALS, TO CLAIM EMPLOYMENT FROM THE CITY AS ASSISTANT PHYSICIANS.
THE JEWISH DOCTORS, EMPLOYED IN VARIOUS VIENNA HOSPITALS FOR A CONSIDERABLE TIME, WERE IGNORED WHEN VACANCIES IN POSITIONS AS ASSISTANT PHYSICIANS OCCURRED, WHICH WERE FILLED BY “ARYANS.”
THEIR CLAIM FOR DAMAGES AGAINST THE VIENNA HEALTH FUND WAS ORIGINALLY DENIED IN THE COURT OF FIRST INSTANCE, WHICH AGREED WITH THE DEFENSE CONTENTION THAT THE FUND WAS ENTITLED TO USE ITS OWN JUDGMENT IN MAKING APPOINTMENTS. THE HIGH COURT HAS NOW REVERSED THIS DECISION, BUT DOUBT WAS EXPRESSED THAT THE VERDICT WOULD HAVE ANY PRACTICAL EFFECT FOR THE JEWISH DOCTORS.
