The Canadian Department of Labor has circularized employers under the Federal Government’s jurisdiction with a memorandum explaining what types of questions asked of a job applicant might be discriminatory under the terms of the Canada Fair Employment Practices Act.
The memorandum points out that questions dealing with nationality or citizenship may be considered discriminatory and suggests that if a position must be filled by a Canadian citizen the applicant be asked “Are you a Canadian citizen?” The memorandum, which stresses that a person’s race, national origin, color or religion rarely affect his work, says that the manner in which a question is asked often determines whether it is discriminatory or not as does the reason for posing the question.
