New complications in the transit situation of New York appeared yesterday when Louis Marshall said in reply to a question that an action would be started to test the power of the Municipal Assembly to grant the city the right to operate buses, it the Assembly should pass the four Craig bills, drawn by the Controller for this purpose.
Mr. Marshall, as attorney in a tax-payer’s action, obtained an injunction to prevent municipal operation of buses more than a year ago. “The Court said in the Schaefer case that are city had no power to operate buses, “Mr. Marshall said. “I don’t think it has any power now.”
