The future of restrictive covenants in the Province of Ontario hinges on a case presently being considered by the Ontario Court Appeals.
The Court is hearing an appeal from a lower bench ruling that agreements barring the resale of resort property, near this city, to Jews and Negroes are valid. The case involves the sale of land to Bernard Wolf, a local Jew. Attorneys for the appellants pointed out in their brief that the lower court’s decision is the first such action in the history of British law.
