Justice Montague has granted a permanent injunction here against William Whittaker, publisher of the Nazi paper, the Canadian Nationalist, prohibiting him from printing libels on Jews.
The injunction proceedings were initiated against Whittaker last November by Captain William Tobias, World War veteran. They were based on a new law passed by the Manitoba legislature, permitting individual members of a race to claim libel damages in cases where the whole race had been libeled.
This is the first judicial procedure of this nature to be undertaken in the British Empire. The specific complaint of libel against. Whittaker’s paper was based on a recent issue of the paper which contained much anti-Semitic propaganda, including the blood ritual libels. Justice Montague’s decision prohibits forever the publication by Mr. Whittaker of anti-Jewish propaganda in his paper.
Neither Mr. Whittaker nor his lawyer turned up in court during the proceedings to defend Whittaker’s stand. Justice Montague thus issued the verdict making an end to a case which has come up for decision several times previously.
Jewish leaders in Canada express keen disappointment that the anti-Semitic publisher evaded appearance in court and took the cowardly course of refusing to face the case openly. Had Mr. Whittaker defended his libelous statements and anti-Semitic views in the courtroom, he would have
