Justice Samuel Irving Rosenman, of the New York State Supreme Court, yesterday refused to grant an injunction to Local 499, which would force the Brotherhood of Painters, Paper-Hangers and Decorators to reinstate the left-wing organization after its expulsion from the parent body several weeks ago. The local was expelled when the Brotherhood claimed that its members were carrying on activities which were detrimental to the present painters’ strike.
At a late hour yesterday afternoon officials of the Brotherhood spoke vaguely about a possible meeting tonight between them and the Association of Master Painters and Decorators to consider arbitration.
The ultimatum which the union offered Monday night to the association ends this morning. The resolution, which declares that if the union’s demands are not met by today the employers’ organization will no longer be recognized, and striking painters will deal directly with individual employers, has not been taken seriously by the association.
The organization is still considering the offer of arbitration which Ben Golden, of the Regional Labor Board, gave Tuesday afternoon.
