The Karlsruhe Court of Appeals ruled today that Ludwig Zind, Offenburg high school teacher arrested on charges involving public anti-Semitic statements, had been arrested without justification. He was released immediately.
Zind had been accused of declaring that Hitler had not gassed enough Jews. He was arrested January 27 after nation-wide protests against the failure of Baden-Wuerttenberg authorities to act against him. A charge of defamation of the memory of the dead was filed against Zind by the Central Council of Jews in Germany.
The Appeals Court decision, which concurred in Zind’s complaint of unjustified arrest, caused consternation in political and legal circles of Baden Wuerttenberg, There were reports that the Federal Ministry of Justice and the Bonn Parliament would step into the case quickly.
