Despite the willingness of both prosecuting and defending attorneys to proceed with the case of Abraham Kaufman, charged with selling non-kosher meat, Magistrate Frederick Hughes yesterday in the Fifth District Court, Brooklyn, continued the case for April 19 in the Adams Street Court for hearing before Magistrate William O’Dwyer.
Magistrate Hughes discounted the claim of Arthur Simon, investigator for the Board of Health, who asserted that previously only an arraignment was made before Magistrate O’Dwyer, and held that inasmuch as sworn testimony was taken before Magistrate O’Dwyer, the latter should dispose of the case, which was started before him.
Kaufman is president of the Neboh Kosher Provision Co., 488 Broadway, Brooklyn, where Simon discovered four barrels each of briskets and tongue on March 13 that, it is charged, were not kosher. On March 15 the hearing was held before Magistrate O’Dwyer. Both the president and the corporation are charged with violating the Kosher law.
